  • Circumventing the 4th amendment for their own agenda...

    I am working on the medic truck tonight and we went out on an automobile accident. Well, it happened on a very rural road with little or no traffic that flows through there. Well, the guy thought nobody is coming to help me and had no cell phone so he walks to his home about a mile away and then calls for help. well we get the call get onscene and there are two sherriffs deputies chomping at the bit waiting to take this guy into custody before the state patrol got there. The patrol arrived fairly quick after we did, and administered a breathalizer without asking the guy, he then proceeds to return to his car and do some paperwork, all the while the deputies are constantly telling the trooper that this guy has a history, and that he needs to be taken into custody immediately. Well, for our own safety I ask the guy what history exactly does he have, he replies that they-the SD have arrested him numerous times and he has beat the system and recieved court ordered dismissals each time. He said that they have been after him for some time now to try to catch him doing something. Well, by now the SHP officer is back with a blood draw kit trying to coerce this guy into giving up his blood freely. The kicker to this is that the state keeps trying to rope the ems providers into taking this bodily fluid without the appropriate consent and paperwork by the person in question...wait it gets worse. If you refuse this blood draw(collection of your blood) the state automatically seizes your license for one year and one day no questions and without due process what so ever. If you refuse, as long as you are uninjured you are then taken into police custody and taken to see the magistrate, then when you get there and still refuse-the magistrate, (not the actual judge)though he has judicial powers, writes a search warrant for your blood-yes your blood, to be obtained by any means necessary to the investigation. Then the SHP has another med unit called to the magistrates office, when they arrive they open the blood draw kit and fill out the paperwork all the while brow beating and talking down to the person in question, then comes the really bad part, by this time if you have not consented after all of the "stern talking to" you just recieved, YOU WILL BE HELD DOWN AND YOUR VERY OWN BLOOD WILL BE TAKEN FROM YOU WITHOUT YOUR CONSENT...PERIOD!!! This is already been written into law at the state level, I personally have refused to take someones blood in this manner and was asked by the SHP "who's side are you on?", I replied while pulling my official pocket version of The Constitution of The United States from my cargo pocket and I cleared my throat and read aloud for all to hear within earshot-the 4th amendment of the united states constitution. I told him that I formally refuse to do this on grounds of it-the act of-being unconstitutional and that I would not be party to such an event. The patrol officer yelled at me and said "I will have you fired for this!", I told him to go ahead and try, that a supreme court justice would like to hear about the constitutional rights violations going on in WNC. They all kind of stopped including my work partner, and one of the officers ask: I thought you were a Marine, and I politely told him that there are no x or former marines...once a marine always a marine, and further more I took an oath to protect this great nation of ours against all enemies foreign and domestic, and the look I recieved was of shear confusion...they were really confused that one person would stand up for someone they did not even know on grounds of the US constitution. This is not a story, this really took place this morning in WNC. I am really wanting out of the "city". This place sucks so bad!!!:cool:

    I take it you are an "oath taker". I think that is a great and wonderful thing you did. If we don't stand up for our rights, no one else will, that's for sure.

    You could have done all this in the name of the job, but you stood up for your principles and the ones in the Constitution. Thank you!

      I hope you have a backup plan for when today's upside-down world hammers you. It will take a considerable amount of time (and money) for your court case to GET to the SCOTUS, if they fire you and you have to take legal action.

      Backup plan, as in a place to move where they can use your skills but are "backwards" in that they still follow the Constitution.

      This reminds me of the pro-life nurse who was forced to participate in a late-term abortion. She objected and they said, "Do it or we'll fire you", so she did it. Now she's suing them for the threat and for what they forced her to do. I think she will lose because she lost all credibility when she participated. Her principles ended at the threat. If she'd NOT participated and gotten fired, she'd have a huge case - like you would have.

        you did the right thing. no doubt about it! i to am a u.s. marine, and i have only one thing to say to you... SEMPER FI HARD CHARGER!!!!! HOOORAW!!

              Being a police officer I run into this fairly often. Even our town ordinance kick around the constitution. I am not an ex-Marine and you have my respect but I am ex-military (8 years AF and 2 years USA). Not only as a military man but as a cop I took the same oath to protect the Constitution against both foreign and DOMESTIC enemies. I assure you that this oath is going to be tested in the near future for all of us.

                  I wear a tam. It's a nice black leather tam, but the difference between it and any other black tam out there is, mine is adorned with the medals of my father, who was in Vietnam.
                  2nd battalion, 94 artillery, medic. I wear these not as a support of current troops, nor do I wear them as rememberance of former troops...I wear them so that people will know that even though I never took an oath to uphold the constitution of the united states, I reflect the reason I choose to by wearing the medals on my hat.

                    Set some time aside to read this oath as I hope all others will or have done. I don't mean to sound condescending ..... in the event that you haven't it will give you some insight as to the significance of what many of us are about to undertake. No bravado but heartfelt dedication to our survival as a society.

                              Mountainman,

                              Great job, the county boys should be on the streets not "chatting" threw their car windows in the parking lot. Sounds to me the "Law" there needs a beating... Their so wrapped up in the mess they don't see it.. most aren't bad people they have been BSed into the results I'd guess. As the the State Trooper? He should be held to a higher standard here.
